What is a rental permit?

A measure to combat substandard housing and rehabilitate old centres

In order to fight more effectively against unfit and degraded housing, PMM is introducing a rental permit. This is a first in the Perpignan metropolis and is one of the concrete actions to improve the quality of housing and mobilize aid for its rehabilitation. The permit to rent came into effect in the territory of Perpignan Méditerranée Métropole on June 2, 2021 and concerns 18 municipalities.

Which Communes are concerned?

In order to fight more effectively against substandard housing, PMM is introducing the "Permit to Rent". This is a prior authorization to rent, reinforcing the fight against substandard housing, by allowing municipalities who wish to do so to implement the "Permit to Rent" to better control the quality of private rental housing.In Perpignan Méditerranée Métropole, 18 municipalities have defined a perimeter in which this new system applies.

What are the relevant perimeters?

For a first rental or a change of tenant, any owner whose dwelling is located in the selected perimeter has the obligation to request prior authorization from the administration. This obligation concerns private lessors who rent empty or furnished housing as their main residence. This measure does not apply to lease renewals, lease amendments, social housing, seasonal tourist rentals and commercial leases.

How do I know if my property is part of the perimeter requiring a prior authorization to be put up for rent?

  • Your property is located in an orange zone: you are concerned by the rental permit.
  • Your property is outside the orange zone: you are not concerned by the rental permit.

F.A.Q permit to rent

The rental permit is valid for two years. After the two-year period, and in case of a change of tenant, the owner will have to apply for a new permit.

This only applies to a new tenancy or a change of tenant. Renewal, renewal of tenancy or amendment to the tenancy agreement are not subject to the rental permit.

The prior authorisation to rent the dwelling is valid for 2 years and is transferred to the new owner of the dwelling.

The latter must nevertheless send the Agglo's services the transfer declaration via CERFA n°15663*01.

Real estate agencies can take care of this procedure. It is advisable to contact your agency to check the terms of the mandate.

On receipt of the complete file, the administration has 30 days to issue its response. After this period, silence is considered as tacit authorisation to rent.

The refusal will be notified by letter, within a maximum of one month from the date of the receipt of the declaration. This letter will specify all the work to be carried out. Once the work has been carried out, in order to rent out your property, you will have to submit a new application.

You can be fined up to €5000. If you fail to comply again within three years, or if you rent out your property despite a rejection decision, the maximum amount is increased to 15,000 euros.
